Golf Oasis LV - Terms and Conditions

1. Acceptance of Terms:
By entering, using, or booking services at Golf Oasis LV (the "Facility") and you (the "User") agree to be bound by these Terms and Conditions. All persons entering the Facility are deemed Users no matter their level of participation whether booking hourly, participating as a member or as an observer. If you do not agree with any part of these Terms, you must not use the Facility or its services.   

2. Booking and Payment:
The User must agree to the reservation and payment policies for using the Facility.

Reservations: Bookings for simulator time are made online or by phone. Reservations are subject to availability.

Payment: Payment is required at the time of booking. 

Cancellation/Rescheduling: Cancellation/Rescheduling: The User can cancel up to 2 hours prior to scheduled booking without penalty or fee. The Facility reserves the right to charge the full booking fee if the User fails to cancel the booking within 2 hours of the reservation. Late cancellations or no-shows may result in forfeiture of payment or a cancellation fee. Cancellations can be made online or by phone.

Pricing: Prices are subject to change without notice.

Memberships (monthly and annual): Memberships are non refundable and are not prorated. 

3. Facility Use and Conduct:

Safety: Users are responsible for their own safety and the safety of others while using the Facility. Please follow all safety instructions and guidelines listed below:
- Wear proper footwear.
- Check surroundings before swinging.
- Be aware of backswing and follow through.
- Only one person in hitting area at a time.
- Report accidents immediately.
- Users must be of legal age to operate the simulator independently.
- Users should be in good health and physical condition to use the simulator. 
- Users must adhere to all laws in their jurisdiction.
- Users must maintain the confidentiality of their account login credentials. 
- Users must notify the facility immediately of any unauthorized use of their account.

Equipment: Damage to the Facility or any components of the bays by the User, whether intentional or due to negligence, may result in liability to repair or replace. 
  Equipment rules are as follows:
- Only golf balls provided by Golf Oasis LV are permitted for use in the Facility. Use of personal golf balls is strictly prohibited. 
- Treat equipment with care and respect.
- Clean club faces before use.
- Keep food and drinks at the provided tables.
- No swinging clubs outside of the simulators swing area.

Conduct: Users are expected to conduct themselves in a respectful and responsible manner. Disruptive or inappropriate behavior will not be tolerated and may result in the termination of your session and/or membership without refund.   

Age Restrictions: Certain areas or activities may have age restrictions. Children must be supervised by a responsible adult at all times.

4. Liability and Waiver:

Assumption of Risk: Users acknowledge that using golf simulators and participating in recreational activities involves inherent risks. You voluntarily assume all risks associated with using the Facility and its services, including but not limited to injury, property damage, or loss.

Waiver of Liability: To the fullest extent permitted by law, Users hereby release and discharge Golf Oasis LV, its owners, employees, agents, and affiliates from any and all liability for any claims, losses, damages, or expenses arising from the users use of the Facility, whether caused by negligence or otherwise.

Indemnification: The Users agrees to indemnify and hold harmless Golf Oasis LV, its owners, employees, agents, and affiliates from any and all claims, losses, damages, or expenses arising from your use of the Facility or any breach of these Terms and Conditions.

5. Personal Property:
Golf Oasis LV is not responsible for any lost, stolen, or damaged personal property.

6. Intellectual Property:
All content, logos, and trademarks displayed at the Facility or online are the property of Golf Oasis LV and are protected by applicable intellectual property laws.

7. Privacy Policy:
Golf Oasis LV collects and uses personal information in accordance with its Privacy Policy, which is available upon request.

8. Modifications to Terms and Conditions:
Golf Oasis LV reserves the right to modify these Terms and Conditions at any time without notice. The most current version are posted online.

9. Governing Law:
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to its conflict of law principles.   

10. Severability:
If any provision of these Terms and Conditions is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.   

11. Entire Agreement:
These Terms and Conditions constitute the entire agreement between you and Golf Oasis LV with respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
